These Terms & Conditions ("Terms") govern your access to and use of the website located at fuelatom.com (the "Website"), as well as any purchases made through the Website.

The Website is operated by Atom Sports Kft., a company registered in Hungary under company registration number 01-09-443846, with registered office at Szent István Körút 1. 3/5A., 1055 Budapest, Hungary, VAT number HU32810994 ("Atom", "we", "us", or "our").

By accessing the Website, creating an account, using our services, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website.

1. Eligibility

By using the Website or placing an order, you confirm that you have the legal capacity to enter into a binding agreement under applicable law.

If you are under the age of 18, you should use the Website and place orders only with the involvement of a parent or legal guardian.

You are responsible for ensuring that all information you provide is accurate, complete, and up to date.

Products sold through the Website are intended for personal use only. Resale of products purchased through the Website is prohibited unless expressly authorized by Atom in writing.

2. Orders and Order Acceptance

When you place an order through the Website, you are making an offer to purchase the products contained in your order.

After placing an order, you will receive an email acknowledging receipt of your order. This email does not constitute acceptance of your order.

A contract between you and Atom is formed only when we send you an order confirmation email confirming that your order has been accepted.

All orders are subject to product availability. We reserve the right to refuse, limit, or cancel any order at our discretion, including where products are unavailable, pricing errors occur, fraud is suspected, or inaccurate information has been provided.

If we cancel an order after payment has been received, you will receive a full refund of the amount paid.

3. Pricing and Payment

All prices displayed on the Website are shown in the applicable currency and include VAT where required by law unless otherwise stated.

Shipping charges, where applicable, are displayed separately during checkout.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.

Payment is processed at the time an order is placed using the payment methods made available through Shopify Payments, including major credit and debit cards, Apple Pay, Google Pay, and other payment methods displayed during checkout.

If payment authorization is declined, your order may not be processed or accepted.

4. Shipping

We currently ship to countries within the European Union.

Shipping rates are calculated at checkout based on your delivery location.

Orders are typically processed within 1–2 business days. Processing times may be longer during periods of high demand or circumstances outside our reasonable control.

Delivery times vary depending on destination and carrier performance and are not guaranteed.

Once your order has shipped, you will receive tracking information where available.

Please ensure your shipping information is accurate before placing an order. Atom is not responsible for delays or delivery issues resulting from incorrect shipping information provided by the customer.

If your order arrives damaged or appears to be lost in transit, please contact us at support@fuelatom.com as soon as possible.

5. Returns and Refunds

Our Return & Refund Policy forms part of these Terms.

Customers may return eligible products within thirty (30) days of delivery in accordance with our Return & Refund Policy.

To be eligible for a return, products must be unopened, unused, and in their original packaging.

Products that have been opened, used, consumed, or otherwise altered after delivery are not eligible for return unless required by applicable law.

Where a return is accepted, Atom will provide a refund using the original payment method used for the purchase.

6. Subscriptions

Certain products may be offered on a subscription basis.

By purchasing a subscription, you authorize Atom to charge your selected payment method automatically at the frequency chosen during checkout.

Subscriptions may be managed through your customer account or subscription portal.

Customers may modify, pause, skip, or cancel their subscription at any time before the next scheduled billing date.

Changes made after a subscription order has already been processed may apply only to future subscription orders.

Subscription discounts do not affect eligibility for returns under our Return & Refund Policy.

We reserve the right to modify, suspend, or discontinue subscription offerings at any time.

7. Fuel Plan Tool

Atom may provide a Fuel Plan tool designed to generate fueling recommendations based on information supplied by users, including details regarding training sessions, races, duration, intensity, environmental conditions, and other relevant factors.

The Fuel Plan tool is provided for informational and educational purposes only.

Recommendations generated by the Fuel Plan tool are estimates based solely on the information entered by the user and general endurance nutrition principles.

The Fuel Plan tool does not provide medical advice, nutritional therapy, diagnosis, treatment recommendations, or professional healthcare advice of any kind.

Individual nutritional needs vary significantly. Users are solely responsible for evaluating whether any recommendation is appropriate for their personal circumstances.

Atom does not guarantee athletic performance, race outcomes, avoidance of gastrointestinal distress, hydration status, recovery outcomes, or any other result based on use of the Fuel Plan tool or our products.

Users should test any fueling strategy during training before implementing it during competition and should consult a qualified healthcare professional where appropriate.

We reserve the right to modify, suspend, or discontinue the Fuel Plan tool at any time without notice.

8. Customer Accounts

Certain features of the Website may require a customer account.

Customers are responsible for maintaining the confidentiality of their account access credentials and for all activity that occurs under their account.

You agree to notify us promptly if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise pose a risk to the Website, our customers, or our business.

9. Intellectual Property

All content available on the Website, including but not limited to text, graphics, logos, images, product names, trademarks, designs, software, website functionality, and Fuel Plan content, is owned by or licensed to Atom and is protected by applicable intellectual property laws.

You may access and use the Website solely for personal, non-commercial purposes.

You may not reproduce, distribute, modify, publish, transmit, create derivative works from, or otherwise exploit any content from the Website without our prior written consent.

The Website, Fuel Plan tool, and all content are provided on an "as is" and "as available" basis.

While we make reasonable efforts to ensure that information on the Website is accurate and up to date, we do not guarantee that all content is complete, accurate, or free from errors.

Food and nutrition products should be stored, handled, and consumed according to the instructions provided. Atom is not responsible for any issues arising from improper storage, handling, misuse, or consumption of products after delivery.

Our collection, use, storage, and processing of personal information are governed by our Privacy Policy, which forms part of these Terms.

By using the Website, creating an account, or placing an order, you acknowledge that your personal information may be processed in accordance with our Privacy Policy.

13. Force Majeure

Atom shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to, natural disasters, extreme weather events, pandemics, governmental actions, war, civil unrest, labor disputes, transportation disruptions, supplier shortages, telecommunications failures, cyberattacks, or interruptions to payment, hosting, or logistics services.

Where such circumstances occur, we will make reasonable efforts to minimize disruption and resume normal operations as soon as reasonably possible.

14. Governing Law and Consumer Rights

These Terms shall be governed by and construed in accordance with the laws of Hungary.

Nothing in these Terms shall limit or exclude any mandatory rights available to consumers under applicable consumer protection laws, including those arising under the laws of the consumer's country of residence within the European Union.

If a dispute arises, we encourage customers to contact us first at support@fuelatom.com so that we can attempt to resolve the matter amicably.

Consumers within the European Union may also be entitled to seek assistance from applicable consumer protection authorities or alternative dispute resolution bodies available in their country of residence.

We may update these Terms from time to time to reflect changes in our business, products, services, legal requirements, or operational practices.

Changes will apply to orders placed after the updated Terms are published.
